Viewing Your Information
The Privacy Act allows a Candidate to look at any personal information held by an Employer, or any persons acting on behalf of an Employer - excluding reference checks under the terms detailed below. You can also seek correction if the information is considered inaccurate.
If a correction is not made, then the Employer, or any persons acting on behalf of an Employer, must take reasonable steps to ensure any Candidate's statement seeking the correction is attached and noted in their Personnel File.
Privacy Policy
The Privacy Act sets clear rules for handling any personal information collected from an Employee or Applicant. It also limits an Employer's, or Agency's, ability to ask a previous Employer about a prospective Employee.
The Act primarily does this by requiring all personal information to be collected only (for a lawful and necessary purpose) directly from the person to whom it relates to; and for that information to be released only with that person's consent.
This means we, and the Employers we are recruiting for, must ask permission from you before approaching a former Employer for a reference. Our Recruiters are experienced professionals with specific industry training and knowledge. Many have worked in the field they now recruit for.
Disclosing Information
Importantly, there is no obligation on us or any Employer to disclose the contents of your reference, if your (the Candidates) Referee have asked or implied that the contents of the reference remain confidential.
We or an Employer can refuse to disclose information, for example, reference checks, on the basis that the references are "evaluative material", provided by you with either an express or implied promise that the information would be held in confidence.
(References are "evaluative material" if they were composed solely for the purpose of "determining the suitability, eligibility, or qualifications of the individual … for employment.")
We are entitled to refuse to disclose your reference, provided that:

The Courts have accepted that generally there is understood to be an implied promise that a reference is confidential to the person requesting it. Note: This position would be greatly enhanced if your email or telephone call requesting the reference expressly told the referee that it would be on a confidential basis.
The reference was compiled solely for the purpose of your request, to present the referee's view of your suitability and qualifications for employment.
